Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Eurekana Sp. z o.o. ("Incade", "we", "us", or "our") regarding your use of the Incade platform. By accessing or using Incade, you agree to be bound by these Terms. If you disagree with any part, you may not use our services.
Service Description
Incade is an ad spend decision engine that analyzes advertising campaign data across multiple platforms and provides actionable recommendations to optimize advertising investments. Our services include:
- • Integration with advertising platforms (Meta, Google Ads, TikTok, LinkedIn, Snapchat)
- • Revenue tracking via Shopify and Stripe
- • Weekly decision recommendations (Scale, Keep, Cut)
- • Historical analysis and trend detection
- • Custom reporting and alert systems
Eligibility
You must be at least 18 years old and have the authority to enter into this agreement on behalf of yourself or your organization. By using Incade, you represent that you meet these requirements.
Account Registration
To use Incade, you must create an account with accurate and complete information. You are responsible for:
- • Maintaining the confidentiality of your login credentials
- • All activities that occur under your account
- • Notifying us immediately of any unauthorized access
- • Ensuring your contact information remains current
Subscription Plans and Billing
5.1 Free Trial
New users receive a 7-day free trial. No credit card is required to start. At the end of the trial, you must select a paid plan to continue using the service.
5.2 Paid Plans
We offer multiple subscription tiers (Starter, Growth, Scale). Pricing is available on our website and is subject to change with 30 days' notice to existing subscribers.
5.3 Billing
- • Subscriptions are billed monthly or annually in advance
- • Payments are processed securely by Stripe
- • Failed payments may result in service suspension
- • All fees are non-refundable except as required by law
Platform Integrations
By connecting third-party platforms (Meta, Google Ads, etc.), you:
- • Grant Incade read-only access to your advertising and revenue data
- • Confirm you have authorization to share this data
- • Acknowledge that connection requires compliance with third-party terms
- • Understand that data quality depends on platform API reliability
We are not responsible for issues arising from third-party platform changes, downtime, or API limitations.
Recommendations and Disclaimers
Important: Incade provides data-driven recommendations, but these are suggestions, not guarantees.
- • You are solely responsible for implementing or ignoring recommendations
- • We do not guarantee specific advertising results or ROI improvements
- • Past performance does not indicate future results
- • Market conditions, seasonality, and other factors affect outcomes
Incade is not liable for any financial losses resulting from following or not following our recommendations.
Acceptable Use
You agree NOT to:
- • Violate any laws or regulations
- • Infringe on intellectual property rights
- • Attempt to reverse engineer, decompile, or hack the platform
- • Use automated systems to scrape or extract data
- • Share login credentials with others
- • Resell or redistribute Incade services
- • Upload malicious code or compromise security
Intellectual Property
All content, features, algorithms, and functionality of Incade are owned by Eurekana Sp. z o.o. and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of your data. By using Incade, you grant us a license to process your data solely to provide our services.
Cancellation and Termination
10.1 Your Right to Cancel
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds for partial months.
10.2 Our Right to Terminate
We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in fraudulent activity. Termination does not relieve you of outstanding payment obligations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- • Incade is provided "AS IS" without warranties of any kind
- • We are not liable for indirect, incidental, or consequential damages
- • Our total liability is limited to the amount you paid in the last 12 months
- • We do not guarantee uninterrupted or error-free service
Indemnification
You agree to indemnify and hold harmless Incade from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any rights.
Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days in advance. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of Poland. Any disputes will be resolved in the courts of Warsaw, Poland.
